1. Agreement to Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you ("you," "your," or "User") and North Texas Cash For Homes ("we," "us," "our," or the "Company"). By accessing or using www.northtexascashforhomes.com (the "Site"), submitting your information, or otherwise engaging with our services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Site or our services.

2. About Our Company

North Texas Cash For Homes is a real estate investment company operating in the Dallas-Fort Worth Metroplex and surrounding North Texas markets. We purchase residential properties directly from owners for cash. We may also assign our purchase contracts to other investors or end buyers in accordance with applicable Texas law.

3. We Are Not a Real Estate Brokerage

We do not provide real estate brokerage services, listing services, agency representation, broker price opinions (BPOs), or formal appraisals. We do not owe you any fiduciary duty as an agent, broker, or representative would. The cash offers we provide are our offers as a buyer.

If you would like representation by a licensed real estate agent or broker, you should engage one separately. If you would like a formal property valuation, you should engage a licensed appraiser. We encourage you to seek independent legal, financial, and tax advice before signing any real estate contract.

4. Equitable Interest & Wholesaling Disclosure

In accordance with Texas Property Code Section 5.0205, you acknowledge and understand the following:

• If we enter into a purchase contract with you and subsequently assign that contract to another buyer, we will be selling our equitable interest in the contract, not the property itself.
• We will provide you and any end buyer with a written disclosure of this equitable interest before assignment.
• The final purchaser of the property may be a different person or entity than North Texas Cash For Homes.
• We may earn a profit on the assignment of the contract that is separate from any consideration paid to you for the property.

You have the right to consult independent legal counsel before entering into any purchase agreement with us.

5. Cash Offers Are Non-Binding Until Contracted

Any cash offer we provide to you, whether verbal, written, by email, or by text, is a non-binding indication of interest until a written purchase agreement is executed by both parties. We reserve the right to:

• Revise our offer based on property inspection, title search, or other due diligence
• Withdraw any offer prior to signing a purchase agreement
• Decline to proceed with any transaction at our sole discretion

Likewise, you are under no obligation to accept any offer we make. Requesting an offer does not create any obligation on your part.

6. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not:

• Use the Site in any way that violates federal, state, local, or international law
• Impersonate another person or misrepresent your affiliation with any person or entity
• Submit false, inaccurate, or misleading information through our forms
• Use the Site to harass, defraud, or harm any other person
• Attempt to gain unauthorized access to the Site, our servers, or related systems
• Scrape, harvest, or otherwise collect information from the Site through automated means without our written consent
• Interfere with or disrupt the operation of the Site

7. Information You Submit

By submitting information to us through the Site, phone, text, email, or other means, you represent that:

• The information you provide is true, accurate, and complete to the best of your knowledge
• You have the legal right and authority to provide such information
• If the property in question is owned by multiple parties or held in trust, you have authority to act on behalf of all owners or have disclosed the ownership situation to us
• You grant us the right to use the information you provide for the purposes described in our Privacy Policy

8. Communications & TCPA Consent

When you submit a form on the Site that includes a consent checkbox, you provide prior express written consent under the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable state laws, for us to contact you using autodialed calls, AI-generated and prerecorded voice messages, text messages, and other forms of communication described in our Privacy Policy.

Your consent is not a condition of any purchase, service, or offer. You may revoke your consent at any time as described in our Do Not Call Policy.

9. Intellectual Property

The Site, including all text, graphics, logos, images, software, and other content, is owned by or licensed to North Texas Cash For Homes and is protected by United States and international intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any Site content without our prior written consent, except as expressly permitted by law (e.g., fair use, personal non-commercial use).

10. Disclaimers

The Site and our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

Without limiting the foregoing, we do not warrant that:

• The Site will be uninterrupted, error-free, or free of harmful components
• Information on the Site is accurate, complete, or current
• Any specific cash offer amount will be provided to you
• Any transaction will be completed
• The Site or our communications are free of viruses or other harmful code

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall North Texas Cash For Homes, its officers, directors, employees, agents, affiliates, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for lost profits, lost revenue, lost data, loss of goodwill, or business interruption, arising out of or in connection with your use of the Site or our services, even if we have been advised of the possibility of such damages.

In no event shall our aggregate liability to you for any claims arising out of or relating to these Terms, the Site, or our services exceed the greater of $100 or the amounts actually paid by us to you in connection with any completed real estate transaction.

12. Indemnification

You agree to indemnify, defend, and hold harmless North Texas Cash For Homes and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Site or our services
• Your breach of these Terms
• Your violation of any law or the rights of any third party
• Any false or misleading information you provide to us
• Any claim by a co-owner, heir, or lienholder of property you offered to sell us

13. Arbitration & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, our services, or our communications with you (a "Dispute") shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, then in effect. Arbitration shall take place in Dallas County, Texas, unless you and we agree otherwise.

You and we agree that any Disputes will be resolved on an individual basis only. You waive the right to participate in any class action, class arbitration, consolidated action, or representative action against us. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative or class proceeding.

Exception: Either party may bring an individual claim in small claims court in Dallas County, Texas, if the claim qualifies for small claims court.

30-Day Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@northtexascashforhomes.com within 30 days of first agreeing to these Terms. Your notice must include your name, address, phone number, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

If this arbitration agreement is found to be unenforceable for any reason, the remainder of these Terms shall remain in effect.

14. Governing Law & Venue

These Terms and any Dispute shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Subject to Section 13 (Arbitration), any legal action permitted under these Terms shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the jurisdiction and venue of such courts.

15. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Provisions of these Terms that by their nature should survive termination (including but not limited to disclaimers, limitations of liability, indemnification, and arbitration) shall survive.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on the Site with a revised "Last Updated" date. Your continued use of the Site or our services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site and our services.
