1. Agreement to Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you ("you," "your," or "User") and North Texas Cash For Homes ("we," "us," "our," or the "Company"). By accessing or using www.northtexascashforhomes.com (the "Site"), submitting your information, or otherwise engaging with our services, you agree to be bound by these Terms and our Privacy Policy.

North Texas Cash For Homes is a real estate investment company operating in the Dallas-Fort Worth Metroplex and surrounding North Texas markets. We purchase residential properties directly from owners for cash. We may also assign our purchase contracts to other investors or end buyers in accordance with applicable Texas law.

3. We Are Not a Real Estate Brokerage

North Texas Cash For Homes is not a licensed real estate brokerage and does not represent buyers or sellers in real estate transactions. We are a principal — we buy properties for our own account or for assignment to end buyers.

We do not provide real estate brokerage services, listing services, agency representation, broker price opinions (BPOs), or formal appraisals. We do not owe you any fiduciary duty as an agent, broker, or representative would. The cash offers we provide are our offers as a buyer.

If you would like representation by a licensed real estate agent or broker, you should engage one separately. If you would like a formal property valuation, you should engage a licensed appraiser. We encourage you to seek independent legal, financial, and tax advice before signing any real estate contract.

In no event shall our aggregate liability to you for any claims arising out of or relating to these Terms, the Site, or our services exceed the greater of $100 or the amounts actually paid by us to you in connection with any completed real estate transaction.

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION AND LIMITS YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, our services, or our communications with you (a "Dispute") shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, then in effect. Arbitration shall take place in Dallas County, Texas, unless you and we agree otherwise.

You and we agree that any Disputes will be resolved on an individual basis only. You waive the right to participate in any class action, class arbitration, consolidated action, or representative action against us. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative or class proceeding.

Exception: Either party may bring an individual claim in small claims court in Dallas County, Texas, if the claim qualifies for small claims court.

30-Day Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@northtexascashforhomes.com within 30 days of first agreeing to these Terms. Your notice must include your name, address, phone number, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

If this arbitration agreement is found to be unenforceable for any reason, the remainder of these Terms shall remain in effect.

14. Governing Law & Venue

These Terms and any Dispute shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Subject to Section 13 (Arbitration), any legal action permitted under these Terms shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the jurisdiction and venue of such courts.

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Provisions of these Terms that by their nature should survive termination (including but not limited to disclaimers, limitations of liability, indemnification, and arbitration) shall survive.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on the Site with a revised "Last Updated" date. Your continued use of the Site or our services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site and our services.
